A workweek can start on any day, but a change must be meant to be permanent and not made to avoid overtime (29 CFR 778.105). Talk to your payroll provider before changing it.

Each job is counted in the workweek it starts. Overtime premium is paid on the regular rate for each workweek (each 14-day period under 8-and-80). California results assume no alternative workweek agreement. General information, not legal or payroll advice.

How to calculate overtime on a 12-hour schedule

Lay the rotation out against your fixed workweeks, total each person's hours per workweek, and pay overtime on every hour over 40 at one and a half times that week's regular rate. On a Panama rotation, a workweek that starts on the first day of the cycle splits the hours into alternating weeks of 60 and 24, so every other week carries 20 hours of overtime. Start the workweek a day later and the same rotation splits into weeks of 48 and 36, and the overtime drops to 8 hours every other week.

    Overtime is counted one fixed workweek at a time, and hours cannot be averaged across weeks, even though the rotation averages 42.

    Find the regular rate

    Apply your state's rule

    California adds daily overtime after 8 hours and double time after 12, so every 12-hour job carries 4 overtime hours. Hospitals on the 8-and-80 system pay overtime after 8 hours a day and 80 in 14 days.

    Price it into the bill rate

    If the client pays overtime at a multiple of the bill rate, the spread holds. If overtime is billed at straight time, every overtime hour comes out of your margin.
